CONTEST RULES
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN. ALL U.S. FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED. MUST BE 21 YEARS OF AGE AND A LEGAL RESIDENT OF GEORGIA TO PARTICIPATE; THIS CONTEST IS APPROVED FOR RESIDENTS IN THE TAYLOR CONSTRUCTION GEORGIA SERVICE AREA ONLY.
1. SPONSORS: The Wilserv Icynene Foam Home Insulation Contest (“the Contest”) is sponsored by Wilserv (“Sponsor”), whose decisions regarding winner selection and all other aspects of the Contest shall be final and binding in all respects.
2. CONTEST PERIOD: The Contest will begin at 12:01am on Saturday, March 1, 2008 and will conclude at 11:59 pm on Saturday, May 31, 2008.
3. ELIGIBILITY: The Contest is only open to legal residents of Georgia who are 21 years of age or older at time of entry. The Resident must reside in the Wilserv Georgia Service area only. Contest void where prohibited by law.
4. HOW TO ENTER: Click on the Wilserv banner ad at wsbradio.com and complete all of the entry information therein. Eligible entries must include all of the information requested during the entry process. Deadline for receipt of entries is 11:59 pm on Saturday, May 31, 2008 in order to be eligible for the drawing. One entry per person. Potential contestants agree that Sponsors will have no liability or responsibility whatsoever for lost, late, misdirected, destroyed, delayed, damaged, incomplete, illegible, postage due entries/mail, or any injuries, losses or damages of any kind resulting from acceptance, possession, attempting to win, or use/misuse of any prize.
5. PRIZES: One (1) prize of up to 1800 sq feet of residential floor attic space insulation courtesy of Wilserv. The resident must be in Wilserv Georgia service area only. Prize is valued at up to $8,000.
6. ODDS: The odds of winning the prize depend on the number of entries received at wsbradio.com.
7. WINNER NOTIFICATION AND ACCEPTANCE: Winner will be chosen by random drawing from all entries received on Monday, June 2, 2008.
All winners will be required to claim their prizes at the offices of News/Talk 750 WSB, 1601 W. Peachtree St., NE, Atlanta, Georgia 30309, during regular business hours Monday-Friday before. Each winner must provide Sponsors with a valid State of Georgia issued photo ID. Each Winner is solely responsible for the reporting and payment of any taxes on prizes. Failure to do any of the foregoing in a timely manner may, at Sponsor’s option, result in forfeiture of prize. Each winner may waive his or her right to receive the prize. No substitutions allowed, except that prize and individual components of the prize package are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Prizes are non-assignable and non-transferable. Contest void where prohibited by law. As a condition of receiving any contest prize, each winner will be required to complete an affidavit of eligibility and a liability and publicity release, which must be signed at the time the winner claims his/her prize at the WSB-AM Business Office. Failure to sign the affidavit or release, or to comply with any term or condition of these Official Rules, may, at the sole discretion of Sponsor, result in a winner’s disqualification and the forfeiture of his or her interest in the prize. Grand prize winner must provide written consent of legal owner of any property upon which any portion of prize is to be installed or remodeled. Except where prohibited, participation in the Contest constitutes each winner’s consent to the publication of his or her name and image in on-air promotional announcements and other promotional material from WSB-AM, and Cox Radio, and on the Cox Radio Interactive Web sites, and to the inclusion of his or her name and image in any other related publications or Web sites for any commercial or promotional purpose, without limitation or additional compensation. Winners’ names may be obtained by sending a request with self-addressed, stamped envelope to News/Talk 750 WSB 1601 W. Peachtree St., NE, Atlanta, GA 30309.
8. PARTICIPATION: Participation in the Contest constitutes an agreement by each contestant to comply with these Official Rules. Sponsor reserves the right to cancel or modify the Contest if it determines, in its sole discretion, that fraud or technical failures have destroyed the integrity of the Contest.
9. LIMITATIONS OF LIABILITY: By entering the Contest, contestants agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with the Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest but in no event attorneys' fees; and (3) under no circumstances will any contestant be permitted to obtain any award for, and contestant hereby waives all rights to claim punitive, incidental or consequential damages and/or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
10. CONSTRUCTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Georgia, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Georgia. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
11. GENERAL RELEASE: By entering the Contest, contestants release Sponsor, any other promotional sponsors and each of their respective parents, affiliated companies, directors, officers, employees, representatives and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light).
12. PROMOTIONAL RELEASE: By submitting an entry, each contestant grants to Sponsor the right to use his or her submission in any manner or media all without further compensation. Each contestant further grants to Sponsor and its affiliates and advertising, promotion and production agencies, and their respective assigns, the absolute right and permission to use his or her name, address, photograph and/or likeness in any and all advertising and promotional materials, in any manner or media whatsoever, for purposes of advertising, trade or promotion. Each contestant acknowledges and agrees that he or she shall have no right of approval, no claim to any compensation, and no claim arising out of the use, alteration, or distortion of his or her name, submission, address, photograph or likeness.
Privacy: Information collected from contestant is used only for the purpose of the prize drawing and to notify potential winners, and will not be re-used, sold or shared in any manner by Sponsor or any third parties unless entrant has opted-in to receive additional information and promotional material from Sponsor or a third party.
